| dc.description | This thesis legal research on the "CUSTOM WITH LEGAL OBLIGATION AS A MAIN SOURCE OF PRODUCTION OF LAW", analyzed the relationships established between the legal and social requirements, a dialectical relationship that has to happen as it moves the society where problem areas punctuated in the legal form of legal custom as source material for production of law, determined the need for research in order to assess their impact on this process, and propose reform proposal to Art. 2 the Civil Code. The formulated objectives and research hypotheses guided the development of the theoretical framework and the doctrine pays a broad frame of reference from which it was possible to analyze various issues considered relevant to our subject; and second, the assumptions routed by the field research. The data analysis of the factual research through surveys and interviews with social sectors involved in the matter, allowed the testing of the hypothesis, the same that being positive was accepted; that is, it is necessary to reform the Art. 2 of the Civil Code, as they must ensure all persons the right legal certainty in the jurisdiction where the Proper Law governs the conduct of persons and the exercise of their rights, Finally, the proposed legal to Art 2 of the Ecuadorian Civil Code reform, limits the time that the legal practice can serve as conclusive evidence in court proceedings, as with the Commercial Code or International Law. | es_ES |
| dc.description.abstract | La presente Tesis de investigación jurídica sobre la “LA COSTUMBRE CON OBLIGATORIEDAD JURÍDICA COMO FUENTE PRIMORDIAL DE PRODUCCIÓN DEL DERECHO”, analizó las relaciones que se establecen entre el orden jurídico y los requerimientos sociales, una relación dialéctica que tiene que darse a medida que avanza la sociedad, donde los campos problemáticos puntualizados en la figura jurídica de la costumbre jurídica como fuente material de producción del Derecho, determinaron la necesidad de realizar la investigación con el fin de valorar su incidencia en este proceso, y plantear propuesta de reforma al Art. 2 del Código Civil. La formularon los objetivos y la hipótesis de investigación orientó el desarrollo del marco teórico, donde la doctrina abona un amplio marco de referencia del que fue posible analizar diversos temas considerados pertinentes con el nuestro objeto de estudio; y por otro lado, la hipótesis direccionó la investigación de campo. El análisis de los datos de la investigación fáctica a través de encuestas y entrevistas a sectores sociales involucrados con el tema, permitió la comprobación de la hipótesis, la misma que por ser positiva fue aceptada; esto es, que es necesario reformar el Art. 2 del Código Civil, pues se debe garantizar a todas las personas el derecho seguridad jurídica en la jurisdicción donde el Derecho Propio norma la conducta de las personas y el ejercicio de sus derechos, Por último, la propuesta de reforma jurídica al Art 2 del Código Civil Ecuatoriano, delimita el tiempo en que la costumbre jurídica pueda servir como prueba plena en los procesos judiciales, como ocurre con el Código de Comercio o el Derecho Internacional. | es_ES |
