| dc.description | This legal research, the theme JUDICIAL DECLARATION OF PATERNITY AND MATERNITY AND ITS IMPACT ON THE INTEGRATION OF HOUSEHOLD, aimed generally determine that the regulatory domain of the judicial declaration of paternity and maternity ensure constitutional right of children to enjoy the care and protection of their parents. For this purpose, we analyzed the legal standard governing the declaration of parenthood contained in Articles 253, 254 and 258 of the Ecuadorian Civil Code for the respective proposal submission. The framework contains thematic aspects of the two variables of the hypothesis, which is based conceptual framework relevant. It analyzed the legal standard governing judicial declaration of paternity and maternity, the same that restrict the content of the constitutional rights of the children, so that the results and information from the field investigation, determined the existence of such legal inconsistencies in those articles of the Civil Code, and the need to reform. Mentioned that legal rules violate the principle of the best interests of the child to dismiss the paternity suit if it proves the blatant misconduct of the mother during the legal period of conception. As for legal reform proposal, it presents a brief background, rationale and objectives. | dc.description.abstract | La presente investigación jurídica, cuyo tema es LA DECLARACIÓN JUDICIAL DE PATERNIDAD Y DE LA MATERNIDAD, Y SU INCIDENCIA EN LA INTEGRACIÓN DEL NÚCLEO FAMILIAR, tuvo como objetivo general, determinar que el campo normativo de la declaración judicial de paternidad y de la maternidad garanticen el derecho constitucional de los hijos e hijas a gozar del cuidado y protección de sus padres. Para el efecto, se analizó la norma jurídica que regula la declaración de paternidad y la maternidad contenida en los artículos 253, 254 y 258 del Código Civil Ecuatoriano para la presentación de la propuesta respectiva. El marco teórico contiene aspectos temáticos de las dos variables de la hipótesis, donde se fundamenta un marco conceptual pertinente. Se analizó la norma jurídica que regula la declaración judicial de paternidad y de la maternidad, los mismos que restringen el contenido de los derechos constitucionales de los hijos e hijas, por lo que los resultados e información de la investigación de campo, determinaron la existencia de tales incongruencias jurídicas en los citados artículos del Código Civil, y la necesidad de reformarlos. Que las normas jurídicas mencionadas violan el principio del interés superior del niño al desechar la demanda de paternidad si se prueba la mala conducta notoria de la madre durante el periodo legal de la concepción. En cuanto a la propuesta de reforma jurídica, ésta presenta un breve antecedente, la justificación y los objetivos.
