| dc.description | The development of the present Thesis of Degree was carried out based on the thesis plan and its methodological points surrendered by the State Technical University of Quevedo, Ability of Right, in the chapter I, the introduction is carried out a synthesis about the necessity that specialized constitutional judges exist she/he stops this way to make effective the constitutional text, considering the preponderant aspects of the neo constitucionalismo that at the moment reigns in the Ecuador. The antecedents of the investigation are described and in the Doctrine it is stood out the thoughts of different actors of the constitutional thought, the taken Jurisprudence of cases in which civic interests have been affected by the irrelevancy of the principle of procedural velocity, the legislation taken as main source the Constitution of the Republic of the Ecuador the Treaties and International Agreements, and effective internal Laws in the Ecuador. She/he is carried out a brief detail on the application of the used methods, the field work by means of surveys applied the citizens, citizens and lawyers in free professional exercise, data that once tabulated, she/he was proven the hypothesis of the investigation. Lastly, the artificial proposal is developed that consists in outlining a reformation to the articles 11 and 20 of the Organic Code of the Judicial, same Function that refer at the beginning of velocity and the judges's specialty and the treatment regarding the time of the juridical causes under its knowledge and the conclusions and recommendations | es_ES |
| dc.description.abstract | El desarrollo de la presente Tesis de Grado se realizó en base al plan de tesis y sus puntos metodológicos entregado por la Universidad Técnica Estatal de Quevedo, Facultad de Derecho, en el capítulo I, la introducción se realiza una síntesis sobre la necesidad de que existan jueces constitucionales especializados para así hacer efectivo el texto constitucional, considerando los aspectos preponderantes del neo constitucionalismo que actualmente impera en el Ecuador. Se describen los antecedentes de la investigación y en la Doctrina se resalta los pensamientos de diferentes actores del pensamiento constitucional, la Jurisprudencia tomada de casos en los cuales se han afectado intereses ciudadanos por la inaplicabilidad del principio de celeridad procesal, la legislación tomada como principal fuente la Constitución de la República del Ecuador los Tratados y Convenios Internacionales, y Leyes internas vigentes en el Ecuador. Se realiza un breve detalle sobre la aplicación de los métodos utilizados, el trabajo de campo mediante encuestas aplicadas a los ciudadanos, ciudadanas y abogados en libre ejercicio profesional, datos que una vez tabulados, se comprobó la hipótesis de la investigación. Por último, se desarrolla la propuesta jurídica, que consiste en plantear una reforma a los artículos 11 y 20 del Código Orgánico de la Función Judicial, mismos que se refieren al principio de celeridad y especialidad de los jueces y el tratamiento respecto del tiempo de las causas jurídicas bajo su conocimiento de las conclusiones y recomendaciones | es_ES |
