| dc.description | This legal research work, I performed with the aim of presenting a legal analysis regarding VIOLATION OF THE RIGHT TO PAYMENT OF UTILITIES AND WORKERS inconsistency with the Constitution, which states that people first meet the set time of work for a year, they have the right to the profits fairer pay, as the current amount violates their fundamental rights. This legal research discussed in the main part for understanding the problem and the effect it was necessary to hypothesize that the solution to the problem was in compliance with the research hypothesis. Then it refers to the theoretical framework, aspects: historical, doctrinal and legal. It describes the methodology used in the investigation at issue; the methods used, the types of research, people, samples techniques and instruments used in data collection. The hypothesis is tested through the research results obtained through interviews with relevant authorities based in Quevedo, in addition to surveys of lawyers in free practice, and then describes the findings and recommendations on the legal solution it proposed. Finally the proposal to the problem is presented. And finally the bibliography, which is the collection of various authors that support the hypothesis. | es_ES |
| dc.description.abstract | El presente trabajo de investigación jurídica, se lo realiza con el objeto de presentar un análisis jurídico respecto a la VIOLACIÓN DEL DERECHO AL PAGO DE LAS UTILIDADES DE LOS TRABAJADORES Y SU INCONSISTENCIA CON LA CONSTITUCIÓN, el cual manifiesta primero que las personas que cumplen con el tiempo establecido de labores desde un año, tienen el derecho que se pague las utilidades más justas, pues la cantidad actual viola sus derechos fundamentales. Esta investigación jurídica trató en la parte principal para el conocimiento del problema y para el efecto, fue necesario plantear la hipótesis de que la solución al problema estaba en el cumplimiento de la hipótesis planteada en la investigación. Luego hace referencia al marco teórico, en los aspectos: histórico, doctrinario y jurídico. Describe la metodología utilizada en la investigación que nos ocupa; los métodos aplicados, los tipos de investigación, la población, las muestras las técnicas e instrumentos utilizados en la recolección de datos. Se comprueba la hipótesis a través de los resultados de la investigación obtenidos mediante entrevistas a autoridades competentes con sede en Quevedo, además de las encuestas realizadas a los Abogados en libre ejercicio profesional, a continuación describe las conclusiones y recomendaciones sobre la solución jurídica que se propone. Finalmente se presenta la propuesta al problema planteado. Y por último la Bibliografía, que es la recopilación de diversos autores que sustentan la hipótesis planteada. | es_ES |
